Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order passed by the fourth respondents by his proceedings dated 20.10.2024 in TR 2024/0103/14/329949TR and quash the same consequently, direct the third respondent to restore the patta numbers of 1648, 4470, 4471 in the name of the writ petitioners for Survey Nos.419/12F and 419/12E for Patta No.1648, Survey No.420/1B, 419/12C, 419/12A bearing patta No. 4470 in the name of the first petitioner and Survey No.419/12B, 420/1A, 419/12D bearing patta No.4471 in the name of the second respondent as per the proceedings of the third respondent dated 27.08.2024 in T.R. 2024/14/04/000242SD.

O R D E R

A Patta Transfer Order dated 20.10.2024 is assailed primarily on the ground of breach of principles of natural justice.

2. On perusal of the impugned order, it is evident that the order was issued pursuant to the petition filed by the seventh respondent 2/5

herein. There is no indication that the petitioners were heard before such order was issued. The order reflects that the petitioners were the only pattadars before the patta transfer. Therefore, by the inclusion of the names of the private respondents, the petitioners' interest has been prejudiced without providing a reasonable opportunity to the petitioners. Consequently, the matter requires reconsideration.

3. For that purpose, the impugned order is set aside and the matter is remanded to the Tahsildar for reconsideration. After providing a reasonable opportunity to be petitioners and the private respondents herein, a fresh order shall be issued within three (3) months from the date of receipt of a copy of this order. No costs. W.M.P.(MD) No.23650 of 2025 is allowed. Consequently, connected miscellaneous petitions are closed.
