This writ Miscellaneous petition filed under Article 226 of the constitution of India to modify the order of this Hon'ble Court in WP(MD) No.10976 of 2013,dt 14/03/2017 to submit the final report before the learned Judicial Magistrate, Melur in to learned Judicial Magistrate No.IV, Madurai .

This writ petition filed under Article 226 of the constitution of India To issue a Writ of Mandamus, directing the Respondent No. 3 to transfer the case in Crime No. 266 of 2008 dated 09/07/2008 on the file of Respondent No. 5 and entrust the same to Respondent No. 4 for investigation of the case by a competent officer and file a final report before the Jurisdictional Magistrate. 1/3

ORDER:- This writ Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.M.Jeyakumar, Additional Government Pleader, for the Petitioner and non apperance for the Respondent, this Court made the following order:

The matter is listed today at the instance of the respondent police, seeking to modify the earlier order of this Court passed in W.P.(MD) No.10976 of 2013 dated 14.03.2017.

2.The learned Additional Government Pleader appearing for the respondent police would submit that the present Judicial Magistrate, Melur, insofar as the investigation conducted by the CBCID is concerned, would be the learned Judicial Magistrate No.IV, Melur, Madurai District. As such, it would be appropriate to direct the investigating officer to file a final report before the learned Judicial Magistrate No.IV, Melur, Madurai District instead of learned Judicial Magistrate, Melur. Subject to this modification, all other observations made in the earlier order dated 14.03.2017 in W.P.(MD) No.10976 of 2013 shall remain intact. 3.Accordingly, this Miscellaneous Petition stands ordered. The Registry is directed to issue fresh order copy to the respective parties.
