[Order of the Court was made by K.K.SASIDHARAN, J.] The petitioner has filed the writ petition directing the respondents not to encroach upon his property in Survey Nos.4B2 & 5B2B at Sathya Nagar, Palani Taluk, Dindigul District to an extent of 2347sq.ft or evicting him without due process of law. 2.Mr.G.Arjunan, learned standing counsel for the second respondent on instruction submitted that Palani Municipality has no intention to encroach upon the patta land of the petitioner in Survey No.4B2 and 5B2B at Sathya Nagar, Palani Taluk, Dindigul District. The said submission is recorded.

3.Since the second respondent has made it clear that they would not encroach upon the patta land owned by the petitioner in the above referred survey number, nothing survives for adjudication.

4.The writ petition is closed with the above observation. No costs. Consequently, connected Miscellaneous Petition is closed.
