Respondents PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 4 to remove the encroachment made by the respondents 6 to 11 in S.No.3/2B of Kappikulam Village, Ottapidaram Taluk, Tuticorin District with fencing by the respondents 6 to 11 based on the petitioner's representation dated 15.09.2025.

ORDER

(Order of the Court was made by DR.ANITA SUMANTH, J.) The petitioner prays for a Mandamus directing the official respondents R1 to R4, for whom Mr.M.Sarangan appears, to remove the encroachments made by R6 to R11 in S.No.3/2B of Kappikulam Village, Ottapidaram Taluk, Tuticorin District.

2.Mr.Sarangan has ready instructions to enable us to dispose the matter finally even at the stage of admission. He circulates a layout sketch in Survey No.3/2B/the subject property to show that fences have been put up by several parties, including R6 to R11 in this Writ Petition. He has also circulated written instructions in Na.Ka.No.884 of 2025, dated 13.11.2025 to the effect that proceedings have been initiated under Section 7 of the Tamil Nadu Land Encroachment Act, 1905 as against R6 to R11. A copy of the notice is circulated and placed on file. 3.In light of the aforesaid, there is no reason for us to keep this Writ Petition pending any further, as the authorities are seized of the matter and will, no doubt, continue and conclude the proceedings in accordance with law and in adherence to the principles of natural justice. 3/6

The notice placed before us indicates that it has been issued to R6 to R11 and hence we dispense with the issuance of notice in the present matter, as their interests have been duly taken note of by the authorities itself.
