O R D E R
(Order of the Court was made by C.V.KARTHIKEYAN,J.) This Habeas Corpus Petition has been filed by a father complaining that his daughter was born on 27.05.2000 and married to the third respondent had been missing on and from 07.10.2025. In this connection, the third respondent had lodged a complaint before the second respondent, the Sub-Inspector of Police, Veerapandi Police Station, to which, FIR in Cr.No.336 of 2025 had been registered under 'woman missing'.
2. The matter came up for consideration on 28.10.2025 and we had adjourned the same on 04.11.2025. However, the learned Additional Public Prosecutor made a representation today that the detenu had been secured and for safety purpose, requested that the Investigating Officer may be permitted to produce her before the Principal District 2/6
Court at Tirupur and make necessary arrangements for the detenu to appear through the Video Conferencing.
3. We contacted the Registry of the Madurai Bench of Madras High Court to issue communication to the Principal District Court at Tirupur. The I Additional District Judge, who was In-charge of the Principal District Judge, Tirupur is present today through the Video Conferencing along with detenu Kowsalya Priyadharshini. The Investigating Officer / Inspector of Police, Veerapandi Police Station, Theni District is also present through Video Conferencing.
4. We had enquired the detenu. She stated that she is not prepared to go with the petitioner / her father or with the third respondent / her husband. She fears for her life. She is stated that she is now residing with one Rajesh Kannan, S/o.Sarava Murugan and Krishnaveni. This statement has been noted by us. The detenu is not missing but has actually been located by the second respondent. No further order is required. We close the Habeas Corpus Petition.
5. The learned counsel for the petitioner has placed a request 3/6
that the petitioner may be permitted to go over to Tirupur to meet the detenu. Any direction in that regard is beyond the scope of the Habeas Corpus Petition, but he may address the second respondent expressing his grievance and depending on the circumstances and sensitive of the entire issues, the second respondent may take a prudent decision after getting further instructions from her Superior Officers.
