O R D E R

This writ petition has been filed seeking the issuance of a writ of mandamus, directing to the respondents 1 and 2 to dispose of the petitioner's representation dated 12.02.2025 with regards to cancellation of subdivision and restore the earlier position of Joint Patta No.1932 and till such time, directing to the third respondent not to survey the property in S.No.239/3B respectively situated in Ayyampalayam Village, Mannachanallur Taluk, Trichy District in accordance with law.

2. Heard the learned counsel for the parties and perused the materials available on record.

3. When the matter was taken up for hearing, the learned Government Advocate appearing on behalf of respondents 1 to 3 submitted that this Court, by its order dated 24.04.2025 in W.P. (MD) No. 11889 of 2025, had directed the second respondent/Revenue Divisional 2/6

Officer to expedite the inquiry on the application of the fourth respondent therein. The survey number in S. No. 239/3B is also the subject property in the present writ petition as well as in W.P. (MD) No. 11889 of 2025. However, the respondents are different in the two writ petitions. Taking into consideration the order of this Court dated 24.04.2025 and the grievance of the petitioner in the present writ petition, the learned Government Advocate submitted that the second respondent will conduct the inquiry by considering the petitioner's representation dated 12.02.2025.

4. Recording the aforesaid submission, without going into the merits of the matter, this Court directs the second respondent to consider and dispose of the representation of the petitioner dated 12.02.2025 by taking in to consideration the earlier order of this Court dated 24.04.2025.

5. Such representation shall be considered after conducting an inquiry, which shall include issuing notice to the petitioner, the joint pattadhars and any other persons who may be affected and considering any objections submitted by them. The second respondent shall thereafter 3/6

pass appropriate orders on merits and in accordance with law. Such exercise shall be completed within a period of eight weeks from the date of receipt of a copy of this order. In the event of any rival claims, the same shall be agitated before the competent civil court. No costs. Consequently, connected miscellaneous petition is closed.
