Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for records in impugned communication in O.Mu. No.2626/A2/2025 dated 07.10.2025 on the file of the 1st respondent and quash the same as illegal and consequently direct the respondents to accord permission to fill up the post of head master in the petitioners school forthwith and pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of the case and thus render justice. 1/4

ORDER
This writ petition is filed challenging the impugned communication in O.Mu. No.2626/A2/2025 dated 07.10.2025 on the file of the 1st respondent and seeking consequential direction to the 1st respondent and quash the same as illegal and consequently direct the respondents to accord permission to fill up the post of head master in the petitioners school forthwith.
2. I have carefully considered the submissions made on either side and perused the materials available on record.

The petitioner school has sought for permission for filling up the vacant post of Headmaster in view of the superannuation of the existing incumbent and the same had been rejected calling upon the petitioner to wait for the period of two years, which has been granted by the Hon'ble Apex Court for the teachers who have been appointed without the qualification of TET to get themselves qualified with TET. The petitioner school had approached the authority to grant prior permission for the 2/4
appointment of Headmaster through direct recruitment with qualification of TET, as there is no qualified teachers working in the petitioner's school for promotion to the post of Headmaster. The school has to necessarily be managed by the Headmaster concerned, who will be administrative head of the school. Hence, the impugned order calling upon the petitioner school to wait for the period of two years, which was given by the Hon'ble Apex Court to enable the teachers working in the petitioner school to clear TET is wholly unreasonable.

For the aforesaid reasons, this writ petition is allowed and the impugned order herein is set aside and the respondents are directed to give prior permission for the appointment of Headmaster to the petitioner's school through direct recruitment. The said exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order. No costs.
