PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to open the admission portal to admit the students for the academic year 2025-2026, consequently by directing the second respondent to receive the balance amount of Rs.4,09,500/- in six equal instalments. O R D E R
The present writ petition has been filed seeking a Mandamus directing the respondent University to open the admission portal to admit the students for the academic year 2025-2026, by directing the second respondent to receive the balance amount of Rs.4,09,500/- in six equal installments.
2. According to the learned counsel appearing for the writ petitioner, the petitioner's college was running Collaborative Programmes. The respondent University is running two courses, namely, B.Sc., Catering and Diploma in Catering. According to him, for the period covering the years from 2018 to 2021, the amount that were collected from the students by the 2/6
college could not be remitted to the University, in view of Covid Pandemic. Therefore, the portal was closed by the University for admission of the students for the academic year 2025-2026. Hence, the present Writ Petition.
3. Per contra, the learned Standing Counsel appearing for the respondent/University submitted that, as on today, the petitioner's college has to pay a sum of Rs.8,01,500/-. In case, if any payment is made on or before 31.03.2026, the portal would be opened and the permission would be granted for the admission of the students from the academic year 2026 - 2027.
4. The learned counsel appearing for the petitioner submits that a sum of Rs.4,00,000/- is due from the University and therefore, the said amount may be adjusted. However, the learned Standing Counsel appearing for the respondents submits that only a sum of Rs.1,75,089/- is due from the University to the College. In case, a sum of Rs.8,01,500/- is remitted by the College to the University, thereafter, a sum of Rs.1,75,089/- would be released by the University in favour of the College. 3/6
5. Considering the interest of the students, the petitioner College is hereby permitted to remit a sum of Rs.8,01,500/- in four equal installments starting from December 2025. In case, if the entire amount of Rs.8,01,500/- is remitted to the University before March 2026, the respondents/University is directed to open the portal for admission for the academic year 2026-2027. The University should not disturb the current academic year students and permit them to appear for the examination.
6. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently connected Miscellaneous Petitions are closed.
