O R D E R
This Writ Petition has been filed seeking issuance of a Writ of Certiorarified Mandamus, to call for the records relating to the survey notice bearing F.L.No.2025/0123/24/017553 (date not mentioned), issued by the first respondent and to quash the same and consequently direct the first to third respondents not to issue any further survey notice in respect of the lands comprised in Survey Nos.440/1A, 440/1A2 and 440/1A6, Page No. 2 of 5
which are adjacent to Survey Nos.440/5, 440/6, 440/7 and 440/8 and also in Survey Nos.440/2, 440/3A, 440/3B and 440/3H, situated at Mullipallam Village, Vadipatti Taluk, Madurai District, until the disposal of O.S.No.636 of 2024 on the file of the Principal District Court, Madurai, and O.S.No.970 of 2021 on the file of the learned Sub Court No. II, Madurai.
2. From a perusal of the impugned notice issued by the first respondent, it is seen that the proposed survey pertains only to Survey No. 440/3H. The said notice has been issued pursuant to the application submitted by the fourth respondent, M.Saranya. It is not known as to why the petitioner has included other survey numbers in this Writ Petition when the impugned notice refers only to Survey No. 440/3H.
3. In view of the above, since the first and second respondents are conducting the survey pursuant to the application made by the fourth respondent, confined to Survey No.440/3H, all the objections raised by the petitioner shall be recorded and the survey shall thereafter be concluded.
