O R D E R

By relying on a sale deed dated 09.07.1959 in favour of the petitioner's mother and the death and legal heirship certificates of the petitioner's mother, the petitioner had applied for mutation of patta in her favour. The present Writ Petition relates thereto.

2. Learned counsel for the petitioner referred to the sale deed and legal heirship certificate and pointed out that the inquiry has been pending for a considerable time, as evidenced by communication dated 20.12.2023.

3. Learned Government Advocate accepts notice for the sole respondent. He submits that the inquiry could not be concluded because parties did not produce the documents called for by the Tahsildar.

4. The legal heirship certificate in relation to Subbulakshmi contains the names of the petitioner and deceased brother, Muniyandi. Therefore, it is necessary for the Tahsildar to identify legal heirs, if any, of Muniyandi. In addition, it appears from communication dated 2/4

20.12.2023 that notice for inquiry had been issued to the petitioner and to three other parties, namely, Gurunathan, Maruthamuthu and Murugesan. It is needless to say that the said parties should also be heard before a decision is taken.

Subject to the above observations, this Writ Petition is disposed of by directing the respondent to consider and dispose of the petitioner's request for patta on merits within three (3) months from the date of receipt of a copy of this order after providing a reasonable opportunity to all parties indicated in the previous paragraph.
