Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the 2nd respondent to mutate the patta in the name of the petitioner by passing final orders on the petitioner's statutory application under Section 10 of the Tamil Nadu Patta Pass Book Act, 1983 in online application No.2025/0103/14/377062 dated 12.09.2025 within the time that may be stipulated by this Court.

By relying on a sale deed dated 17.02.2025 and patta No.858 in the names of the petitioner's vendors, the petitioner had applied for mutation of patta under Section 10 of the Tamil Nadu Patta Passbook Act 1983. By this Writ Petition, the petitioner seeks the early disposal of such application.

2. Learned Special Government Pleader accepts notice for both the respondents. By referring to the order dated 08.09.2025 of the District Revenue Officer, he submits that a third party, namely, M.Manimaran, had applied for cancelling the patta transfer in the name of the petitioner's vendors and to instead grant the patta in the name of Sindhamanipatti Mariamman Temple. Since the order is recent, he submits that it needs to be verified as to whether a civil suit has been filed against the said order.

3. The petitioner has applied for a patta transfer on the basis of both the title document and the revenue record standing in the name of 2/4

the vendors. As such, a case is made out for the consideration of such application.

For reasons aforesaid, this Writ Petition is disposed of by directing the first respondent to consider the petitioner's application for mutation and dispose of the same on merits within three (3) months from the date of receipt of a copy of this order after providing a reasonable opportunity to the petitioner, Manimaran and any other persons interested. No costs.
