O R D E R

By relying on a sale deed dated 07.01.2011 and patta No.881, the petitioner had applied for a survey of land in survey No.24/3A4 of an extent of 6 cents. The present Writ Petition relates thereto.

2. Learned counsel for the petitioner submits that the suit filed by P.Poochiya Pillai and P.Kumar in O.S.No.1054 of 2019 was dismissed by judgment and decree dated 29.03.2023. She submits further that the application filed by the plaintiffs to condone delay in filing the first appeal was dismissed by an order dated 05.03.2025. Therefore, learned counsel contends that there is no impediment in conducting a survey.

3. Learned Government Advocate accepts notice for both the respondents. He submits that an inquiry would be conducted after issuing notice to the petitioner, P. Poochiya Pillai, P. Kumar and the owners of relevant adjacent lands.

4. In view of the above submissions, this Writ Petition is disposed of by directing the respondents to conduct an inquiry in relation to the 2/4

petitioner's application for a survey by issuing notice to the petitioner, P.Poochiya Pillai and P.Kumar. Notice shall also be issued to owners of relevant adjacent lands.
