O R D E R

This Criminal Original Petition is filed to quash the impugned FIR registered for the offences under Sections 296(b), 324(4) & 351(3) of BNS, 2023.

2. The gist of the allegations in the FIR is that the petitioners on account of previous enmity had threatened the defacto complainant with dire consequences by wielding a huge knife and an iron rod and thus, committed the aforesaid offences.

3. The learned counsel for the petitioners would submit that the parties have now arrived at a compromise and produced a joint compromise memo.

The learned Additional Public Prosecutor appearing for the first respondent, on instructions, would submit that the investigation in the impugned FIR was concluded and the final report has been filed only for the offence under Section 27(1) of the Arms Act, 1959 before the Judicial Magistrate, Kadaladi.

5. It is seen that even according to the first respondent, the major allegations in the FIR are not true. In any case, the parties have now arrived at a compromise and the defacto complainant do not wish to pursue the case.

The petitioners, namely, Gowthamarajan (Aadhaar No.8819 2534 1610), Alaguraja (Aadhaar No.9203 2213 4394) and the second respondent, namely, Ganesan (Aadhaar No.4221 2143 8879) are present before this Court in person. They are identified by Mr.A.Karthick, Sub Inspector of Police, Sayalkudi Police Station, Ramanathapuram District All the parties confirmed the compromise arrived at between them.

In view of the same and considering the nature of the allegations and since the defacto complainant himself does not want to pursue the complaint, no useful purpose would be served in keeping the impugned FIR pending investigation. Accordingly, the impugned FIR in Crime No. 184 of 2025 dated 22.09.2025 and the consequential final report filed before the Judicial Magistrate, Kadaladi are quashed and the Criminal Original Petition stands allowed.

8. The petitioners shall pay a sum of Rs.10,000/- (Rupees Ten Thousand only) as costs to the Mediation and Conciliation Centre attached to this Bench forthwith and file a photocopy of the receipt along with a memo, reporting compliance in the Registry.
