Heard both sides.

2. The impugned order has been passed without serving the copy of the inspection report which is a relied upon document. The learned counsel for the petitioner draws my attention to the order dated 15.09.2025 made in W.P. (MD)No.25204 of 2025 (Balasubramanian Blue Metals Vs. Additional Chief Secretary to Government).

3. Adopting the very same approach, the impugned 2/4

3 W.P.(MD)NO.30644 OF 2025 proceedings stand quashed. The matter is remitted back to the file of the third respondent. The third respondent shall serve the copy of the inspection report to the writ petitioner. The petitioner is given four weeks time to respond thereafter. After holding enquiry, it is open to the third respondent to pass an order afresh in accordance with law. The merits of the matter have not been gone into. It is needless to mention that the transit pass will be issued till the final order is passed.

4. The writ petition is allowed. No costs. Consequently, connected miscellaneous petition is closed.
