Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents remove the encroachment made by the 6th respondent in S.No.201/1 and 201/2 in Kalluvaikkal situated at 3, Sirugamani East Village, Thiruvarangam Taluk, Karur Registration District, Trichy District and maintain the same free of any encroachment, based on the representation of the petitioner dated 22.07.2025. For Petitioner : Mr.B.Prsanna Vinoth For Respondents : Mr.C.Venkatesh Kumar, Spl. Government Pleader for R1 to R5.

ORDER

Heard the learned counsel for the writ petitioner and the learned Special Government Pleader for the respondents 1 to 5. Issuance of notice to the sixth respondent is dispensed with. 2.The petitioner alleges that there are encroachments in the petition mentioned survey numbers. We perused the extracts of "A" register. It is seen therefrom that S.No.201/1 has been classified as waterbody. But S.No.201/2 is the patta land. Therefore, no direction can be issued in 2/6

respect of S.No.201/2.

3.We direct the third respondent to conduct survey of S.No.201/1. Notices will be issued to all the interested persons. If the survey exercise reveals that there is encroachment, individual notices will be issued to all the encroachers and by adhering to due process of law, the encroachments shall be removed. The entire exercise shall be completed within a period of three months from the date of receipt of a copy of this order.
