ORDER

This writ petition has been filed seeking Mandamus directing the first respondent to issue passport to the petitioner by considering his passport application in File No.TR1065470523825 on the file of the first respondent by considering the representation dated 14.10.2025 given by the petitioner.

Heard the arguments of the learned counsel appearing for the petitioner and Mr.B.Narayan Ram, learned counsel, who takes notice on behalf of the first respondent and Mr.S.Prakash, learned Government Advocate (crl.side), who takes notice on behalf of the second and third respondents. By consent, this writ petition is taken up for final disposal at the admission stage itself.

3. It is the case of the petitioner that he intended to travel abroad and was therefore required to obtain passport; accordingly, he submitted an application seeking its issuance in File No.TR1065470523825 dated 24.09.2025. During 2/5

the course of its process, he has received a clarification notice dated 30.11.2025 from the first respondent directing him to give explanation regarding pendency of the cases registered against him in Crime No.426 of 2010 pending on the file of the second respondent and Crime Nos.66 of 2019 and 467/2020 pending on the file of the third respondent. The petitioner had also submitted an explanation vide his letter dated 14.10.2025. However, the same has not been considered to date and he has not been issued with passport. Therefore, he is before this Court.

The learned Government Advocate (crl.side), on instructions, would submit that the complaint has been lodged against the petitioner and others and a case was registered in Crime No.426 of 2010 for the offence under Sections 147, 307, 323 of IPC and Section 3 of TNPPDL Act, Crime No.66 of 2019 for the offence under Sections 294(b), 447 and 506(i) of IPC and Section 3 of TNPPDL Act and Crime No.467 of 2020 for the offence under Sections 294(b), 352 and 506(i) IPC. In all cases, investigation has been completed and charge sheets have also been filed before the learned Judicial Magistrate, Alangudi.

5. In view of the above, the relief sought for by the petitioner cannot be granted. It is open to the petitioner to approach the concerned jurisdictional 3/5

Magistrate for issuance of passport. The said application shall thereupon be considered as per the provisions of the Act. Accordingly, this Writ Petition is dismissed. No costs.
