ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 09.10.2025 for the offences punishable under Sections 69, 296(b) and 351 (2) of BNS 2023, in Crime No.436 of 2025 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner had made a false promise of marrying the victim girl and he had committed penetrative sexual assault on her. Thereafter, the petitioner demanded a sum of Rs.5 lakhs and a Car and threatened to kill her. Hence, the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court and he is in judicial custody from 09.10.2025. Hence, he seeks bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that the victim is aged about 28 years and investigation is not yet completed. Hence, he opposed for grant of bail to the petitioner.

Taking into consideration of the facts and circumstances of the case and considering the fact that the petitioner has sexually assaulted the defacto-complainant several times under the promise of marrying her, but refused to marry her and also considering the nature of the offences and also the fact that the investigation is at the preliminary stage, this Court is not inclined to grant bail to the petitioner.
