Prayer: Criminal Original Petition is filed under Section 528 of BNSS, 2023, to direct the 2nd and 3rd respondents not to harass the petitioner and his family members under the guise of enquiry.

ORDER

This Criminal Original Petition is filed to direct the respondents 2 and 3 not to harass the petitioner and his family members under the guise of enquiry.

2. The learned Additional Public Prosecutor, on instructions, would submit that the enquiry is pending on the complaint given by the fourth respondent, who is the wife of the petitioner and that the same would be completed within a period of two weeks.

3. It is needless to say that the respondent Police in the guise of enquiry cannot harass any person. However, if the petitioner's presence is required for enquiry, the respondent Police shall issue summons and complete the enquiry within a period of two (2) weeks from the date of receipt of a copy of this order.

4. With the above observations, this Criminal Original Petition is disposed of.
