PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 3 to remove the encroachment made by the respondents 4 to 9 on the basis of the second respondent proceedings dated 15.04.2025 within time stipulated by this Court.

ORDER
(Order of the Court was made by DR.ANITA SUMANTH, J.) The petitioner seeks a Mandamus directing R1 to R3 to remove the encroachments allegedly made by R4 to R9. 2.Ms.S.Nandhini, learned counsel appearing for the petitioner states that earlier proceedings were initiated to clear the encroachments in Vandi Pathai Poramboke in Survey No.15/6, Othaveedu, Koodakovil Panchayat, Kallikudi Taluk, Madurai District and proceedings in Na.Ka.No.1652/2024/A2, dated 15.04.2025, were issued. In that proceedings, the official respondents had indicated that the 2/5
encroachments would be removed by 23.04.2025, notwithstanding which, nothing has been done so far. Hence this Writ Petition. 3.Mr.M.Sarangan, learned Additional Government Pleader, accepts notice for R1 and R2 and Mr.S.P.Maharajan, learned Special Government Pleader accepts notice for R3.
4.It is agreed that no action has been taken thus far to clear the encroachments, as, according to Mr.Sarangan, learned Additional Government Pleader, some of the parties who were tentatively identified as being encroachers were in a position to produce some documents to establish their title. The delay is on account of this circumstance. He has now produced a compilation of documents, the first of which is the proceedings dated 04.11.2025, to the effect that action will be taken to remove the encroachments.
5.When we had sought about the stage of the proceedings, Mr.Sarangan, informs that Section 7 notice of the Tamil Nadu Land Encroachment Act, 1905 ('Act') issued initially did not contain sufficient particulars as to the relevant provision and hence, the authorities were unable to pursue the same to its logical conclusion. 3/5
6.The authorities will ensure that proper notices are issued under the Act and that the needful is done positively within a period of twelve weeks, in accordance with law.
7.This Writ Petition is disposed. No costs.
