Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Certiorari, to call for the records pertaining to the impugned order in Na.Ka.No.1210/Aa1/2013, dated 03.07.2013, on the file of the respondent No.3 and quash the same as illegal to the extent of declaring one out of the two existing Physical Education Teachers at 5th respondent School as surplus.

ORDER

The order, treating the writ petitioner as a surplus teacher in proceeding dated 03.07.2013 is under challenge in the present Writ Petition.

2.The learned counsel appearing on behalf of the writ petitioner now brought to the notice of this Court that based on the current inspection report, adequate students strength is available in the school and post of the writ petitioner is continuing, in view of the increase in the students strength. Thus, the post, in which the writ petitioner is accommodate, is no more surplus. 3.In view of the changed circumstances on account of efflux time, this Court is of the considered opinion that no further adjudication is required in the present Writ Petition. Accordingly, this Writ Petition stands closed. No costs. Consequently, connected miscellaneous petitions are closed.
