ORDER

The petitioner seeks a direction to the respondents 1 and 2 for survey and fencing the property situated in S.No.126/3A and S.No.126/3B in Balakrishnampatti East Village, Thuriyur Taluk, Tiruchirappalli District in light of the 5th respondent communication to the 2nd respondent, dated 18.07.2025 vide Na.Ka.Aa2/4945/2025 by considering the petitioner's representation, dated 25.08.2025.

The learned counsel for the petitioner would submit that in an earlier Writ Petition filed before this Court in W.P.(MD) No.8793 of 2025, this Court had directed the respondents 1 and 2 therein, namely the Tahsildar and the Taluk Surveyor, to conduct a survey in the presence of the jurisdictional Police. However, the said survey has not yet been conducted.

3. The learned Additional Public Prosecutor, on instructions, would submit that the Tahsildar, Thuraiyur Taluk, Trichy District, had addressed a letter to the Sub-Inspector of Police seeking police protection for conducting 2/5

the survey on 19.07.2025. However, the survey could not be conducted as there was a law and order problem.

Since there is already a direction issued by this Court to conduct the survey in the presence of police officials, the respondents 1 and 2 herein are directed to provide police protection as and when a request is made by the Taluk Surveyor for conducting the survey, after issuing notice to respondents 3 and 4. It is made clear that this Court has not issued any direction for providing police protection for fencing the property.
