Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records relating to the second respondent in his proceedings letter No.A2/3046/07 (4081) Napa 10A, dated 26.11.2007 and quash the same and direct the second respondent to appoint the petitioner on the compassionate ground.

O R D E R

This petition has been filed to issue a Writ of Certiorarified Mandamus, calling for the records relating to the second respondent in his proceedings letter No.A2/3046/07 (4081) Napa.10-A dated 26.11.2007 and quash the same and direct the second respondent to appoint the petitioner.

2. In this writ petition the counter affidavit has been filed by the second respondent wherein it is stated that the second respondent had infact recommended the case of the petitioner to the third respondent for providing appointment on compassionate appointment.

However the third respondent in his letter No.C4/16914/2007, dated 12.11.2007, returning the said proposal stating that the application of the petitioner was not received in the Department well within the prescribed period as per G.O.Ms.No.120, Labour and Employment Training Department, dated 29.06.1995.

3. Based on the counter filed by the second respondent, it is seen that the petitioner has made a representation beyond the time limit prescribed. Hence, this Court is not inclined to grant any order.
