ORDER

This writ petition has been filed seeking issuance of a Writ of Mandamus to direct the respondents 1 and 3 to conduct an enquiry under Section 131 of the Tamil Nadu Village Panchayat Act, 1994, on the basis of the representation submitted by the petitioner dated 02.09.2025.

2. Mr.D.Sasikumar, learned Additional Government Pleader, takes notice for the respondents 1 to 3. Since no adverse order is going to be passed as against the respondents 4 and 5, notice to them is dispensed with. By consent, the writ petition itself is taken up for final disposal at the admission stage.

The learned counsel for the petitioner submitted that the petitioner has given a detailed representation dated 02.09.2025 to the official respondents, alleging that the respondents 4 and 5 are preventing him from using a pathway. However, till date, no enquiry has been initiated or order has been passed on the said representation. Hence, the petitioner has approached this Court for appropriate directions. 2/5

4. On the other hand, the learned Additional Government Pleader appearing for the respondents 1 to 3 submitted that the the third respondent will consider the petitioner's representation in accordance with law, after verifying the factual aspects and following due procedure.

Considering the limited relief sought by the petitioner and taking note of the submissions of both sides, this Court, without expressing any opinion on the merits of the matter, directs the third respondent to consider the petitioner's representation dated 02.09.2025, conduct an enquiry as contemplated under Section 131 of the Tamil Nadu Village Panchayat Act, 1994, and pass appropriate orders on merits and in accordance with law, after affording due opportunity to the petitioner as well as the affected parties, within a period of two months from the date of receipt of a copy of this order.
