ORDER
This Criminal Original Petition is filed to quash the impugned final report in Spl.S.C.No.111 of 2024 on the file of the Fast Track Mahila Court, Dindigul, which was filed for the offences under Sections 7 and 8 of Protection of Child from Sexual Offences Act, 2012 r/w. Section 366 of IPC.
2. The allegation in the final report is that the petitioner had abducted the victim girl and had committed sexual assault on her.

The learned counsel for the petitioner and the learned counsel for 2nd and 3rd respondents would submit that the petitioner had a love affair with the victim girl, whose date of birth is 16.06.2006; that she has now attained majority; and that the petitioner and the victim girl got married on 23.05.2025, and subsequently registered their marriage on 06.06.2025. The marriage certificate has been produced before this Court.
4. The petitioner, de-facto complainant, and the victim girl are present before this Court in person and have been identified by Mr.R.Jawahar, Special 2/5
Sub-Inspector of Police, Palani Town Police Station, Dindigul District. They confirmed the marriage of the victim girl with the petitioner. The parties have also filed a joint compromise memo dated 10.11.2025.

The Hon'ble Supreme Court in the case of Mahesh Mukund Patel vs. State of U.P. and Others reported in 2025 SCC OnLine SC 614 had held that in a case of this nature, where the victim, after attaining majority has married the accused and their marriage has also been registered, no useful purpose would be served in continuing the prosecution and that it would cause undue hardship to all the parties concerned.

Considering the fact that the petitioner has married the victim girl, who has now attained majority, and that the marriage has been registered, and in view of the aforesaid observations made by the Hon'ble Supreme Court in Mahesh Mukund's case (cited supra), this Court is of the view that no useful purpose would be served in continuing the prosecution. Accordingly, the impugned final report in Spl.C.C.No.111 of 2024 on the file of the Fast Track Mahila Court, Dindigul, is quashed. The petitioner shall pay a sum of Rs.10,000/- (Rupees Ten Thousand only) as costs to the Mediation and Conciliation Centre attached to this Bench forthwith and file a photocopy of the 3/5
receipt along with a memo reporting compliance in the Registry. The joint compromise memo dated 10.11.2025 shall form part of this order.
