PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 2nd and 3rd respondents to survey and demarcate the four boundaries of the petitioner's patta lands vide in Survey No. 8-3A1 in Padhipatti, Pudukkottai District, within a time frame as may be fixed by this Court and further direct the 4th respondent to provide necessary protection for the same.

ORDER

By relying on sale deed dated 20.07.1998(document No.1233 of 1998), gift deed dated 12.11.2018 and patta No.1130, the petitioner had applied on 16.09.2025 for survey of land in S.No.8/3A1. The present writ petition relates thereto.

2. Learned Additional Government Pleader accepts notice for the respondents 1 to 3 and learned Government Advocate(crl.side) accepts notice for the 4th respondent. Learned Additional Government Pleader submits that action would be initiated on the petitioner's request for survey after issuing notice to the 5th respondent and the owners of any other relevant adjacent lands. He also submits that objections, if any, from the said persons would be taken into consideration before a decision is taken.

3. In view of the said submissions, it is not necessary to issue notice to 5th respondent in this writ petition. Instead, this writ petition is disposed of by directing the 2nd and 3rd respondents to initiate action on the petitioner's 2/4

application for survey by issuing notice to the 5th respondent and owners of relevant adjacent lands and considering objections, if any, from them. The entire process shall be concluded within three months from the date of receipt of a copy of this order. No costs.
