ORDER

The petitioner is the sole accused in Spl.C.C.No.33 of 2021 on the file of the Sessions Judge, Special Court for POCSO Act Cases, Tirunelveli. The trial Court by judgment dated 26.09.2025 found the petitioner guilty, convicted and sentenced him as under: (i) to undergo five years rigorous imprisonment and to pay a fine of Rs.3,000/-, in default, to undergo one year rigorous imprisonment for the offence under Section 11(i) r/w 12 of the POCSO Act; (ii) to undergo one year rigorous imprisonment and to pay a fine of Rs.2,000/-, in default, to undergo three months rigorous imprisonment for the offence under Section 9(m) r/w 10 of POCSO Act ; Challenging the judgment of conviction and sentence, the petitioner has filed a Criminal Appeal in Crl.A(MD)No.1270 of 2025 and the same has been admitted by this Court on 25.11.2025. Along with the appeal the petitioner has filed this petition to suspend the sentence. 2.Heard the learned counsel on either side.

3.The petitioner 54 years old at the time of occurrence is said to have abused a 8 year old child. The case of the prosecution has been established by the evidence of the child and the evidence of the neighbour / PW4. Considering the available materials, this court is not inclined to entertain this petition.
