: Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying for the issue of a Writ of Mandamus, directing the first respondent herein to consider the petitioner's representation dated 19.01.2011 within a stipulated period as may be fixed by this Court and pass any other appropriate order which may deem fit and proper in the nature and circumstances of the case herein.

ORDER
****** The petitioner seeks a Writ of Mandamus, directing the first https://hcservices.ecourts.gov.in/hcservices/
respondent to consider his representation dated 19 January, 2011 and allot him a house under the Kalaignar Housing Scheme.
2. None appears on behalf of the petitioner.
3. The learned Government Advocate, on instructions, submitted that the third respondent finalized the list of beneficiaries under the Kalaignar Housing Scheme. The name of the petitioner was included at Serial No.49. The said fact was intimated to him. The petitioner failed to sign the application form. The petitioner was intimated by letter dated 29 April, 2011 that his name has been registered in the select list of beneficiaries under the Kalaignar Scheme 2010-2016.
4. Since the name of the petitioner has already been enlisted under the Scheme, there is no question of directing the first respondent to pass an order on the application. It is always open to the petitioner to approach the first respondent, in case he has not been given a house, pursuant to the Scheme, in view of his seniority position in the select list.
5. I also make it clear that this order would not stand in the way of the petitioner applying for allotment of house under any other Scheme in operation.
6. The Writ Petition is disposed of with the above direction. No costs.
