The writ petition has been filed for a Writ of Mandamus directing the respondents herein to disburse the withheld sum of Rs.93,684/- towards earned leave salary payable on the retirement of the petitioner together with interest.

2. Heard the learned counsel for the petitioner and the learned counsel for the respondents.

3. Though the writ petition is filed for the larger relief, the learned counsel appearing for the petitioner would submit that the grievance of the petitioner will be met out, if the representation given by the petitioner on 20.12.2010 to the third respondent is considered on merits.

4. In view of the above, without going into the merits of the petitioner's claim, the third respondent is directed to consider the representation of the petitioner, dated 20.12.2010 and pass orders on merits and in accordance with law, within a period of three weeks from the date of receipt of a copy of this order.

5. With the above direction, the Writ Petition is disposed of. No costs. Consequently, the connected Miscellaneous Petition is closed.
