ORDER

Heard both sides.

2. The writ petitioner challenges the impugned notification issued by the first respondent proposing to grant permit for the new route. The petitioner challenges the same on the ground that the new route overlaps with a served sector beyond the permitted distance.

3. The learned Special Government Pleader points out that the petitioner as well as his wife had applied in response to the impugned notification and that therefore, the petitioner may not have any locus to maintain the writ petition.

4. The learned counsel for the petitioner rebuts the said submission by pointing out that yesterday, the petitioner has taken back his application.

5. I am of the view that the writ petition has been prematurely filed. The grant is going to be based on the draw of lots. As and when permit is issued, the petitioner can file an appeal before the tribunal on the grounds projected in this writ petition.
