Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondents 1 to 3 to take appropriate action against the 4th Respondent for his illegal quarrying of sand from unauthorized area which are not come under the permit order of the second respondent dated 07.12.2012 in RC No. 902/Kanimam/2012 at M.Pudur Village, Thottiam Taluk, Trichy District consequently forbearing the 4th respondent from illegal quarrying of sand from unauthorized area and pass such further or other orders. ORDER

(Order of the Court was made by R.SUDHAKAR,J.) https://hcservices.ecourts.gov.in/hcservices/ This is a case of illegal sand quarry in unauthorized areas, which are not come under the permit order of the second

respondent dated 07.12.2012. In this regard, the petitioner has given a representation on 13.05.2013 to the District Collector/second respondent herein.

2. The learned Additional Advocate General appearing for the respondents 1 to 2 states that permission for sand quarrying operation is expired by August 2013. Therefore, the question of issuing any direction, not to quarry, does not arise. However, in respect of the allegation of illegal quarrying is concerned, the authority concerned may consider the nature of the grievance expressed by the petitioner and take appropriate action if warranted.
