ORDER

The petition has been filed to modify the condition imposed in Crl.O.P.(MD) No. 16759 of 2025 dated 06.10.2025, by this Court.

2. The learned counsel for the petitioner submitted that the petitioner prays for

modification of the condition (C) imposed by this Court in Crl.O.P.(MD) No.16759 of 2025 dated 06.10.2025.

3.Considering the facts and circumstances of the case, this Court is inclined to modify the condition (C) imposed by this Court against the petitioner in Crl.O.P. (MD) No.16759 of 2025 dated 06.10.2025.

4.Accordingly, the condition (C) imposed against the petitioner in Crl.O.P. (MD) No.16759 of 2025 dated 06.10.2025, i.e.,"[c] the petitioner shall make deposit of Rs.1,00,000/- (Rupees one Lakhs only) to the credit of Crime No.280 of 2025, without prejudice to his defence before the trial Court; and on such deposit being made, the learned Judicial Magistrate No.1, Usilampatti shall accept the sureties furnished by the petitioner; the learned Judicial Magistrate No.1, Usilampatti shall deposit the said amount as fixed deposit in a Nationalized Bank and the entitlement of the said amount will be decided at the time of disposal of the main case.", is modified as under:

"[c] the petitioner shall make deposit of Rs.75,000/- (Rupees Seventy Five Thousand only) in two installments to the credit of Crime No.280 of 2025, without prejudice to his defence before the trial Court; the 1st installment of Rs.40,000/- shall be paid at the time of producing sureties and on such deposit being made, the learned Judicial Magistrate No.1, Usilampatti shall accept the sureties furnished

by the petitioner; the 2nd installment of Rs.35,000/- shall be paid on or before 31.01.2025; the learned Judicial Magistrate No.1, Usilampatti shall deposit the said amount as fixed deposit in a Nationalized Bank and the entitlement of the said amount will be decided at the time of disposal of the main case." 5.The time period fixed by this Court in the Crl.O.P.(MD) No.16759 of 2025 dated 06.10.2025, for producing sureties is extended by this Court further for a period of fifteen days from today.
