Writ Petition is filed under Article 226 of the Constitution of India for the issue of a Writ of Mandamus directing the first respondent to consider the petitioner's representation dated 05.07.2012 and pass orders. ORDER

The prayer in the Writ Petition is to issue a Writ of Mandamus directing the first respondent to consider the representation of the petitioner dated 05.07.2012 and pass orders.

2. Today, when the Writ Petition is taken up for hearing, the learned counsel appearing for the third respondent would submit that the third respondent had already filed Succession O.P.No.2 of 2013, on the file of the Additional Sub Court, Tirunelveli and the petitioner herein is not a party to the said proceedings.

3. In such view of the matter, the petitioner will make necessary application to implead himself as a party to the pending Succession Proceedings and the authorities concerned will abide by the result of the said proceedings.

4. The Writ Petition is disposed of on the above terms. No costs.
