ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 10.10.2025 for the offences punishable under Sections 279, 337, 1/6

304(2) IPC @ Sections 279, 304(2), 338 IPC r/w. 185 MV Act, 1988 in Crime No.509 of 2020 in S.C.No.85 of 2022 on the file of the Principal District and Sessions Judge, Karur, seeks bail.

The case of the prosecution is that on 13.09.2020 at about 2.15 pm, when the complainant was at his bakery, the victim came in their car bearing Regn.No.TN 05 P 5332 from East to West on the Trichy to Karur Road and the accused came in his Eicher van bearing Regn.No. Ka 51 B 5067 from West to East on the same road in a rash and negligent manner in an inebriated condition and dashed against the car of the victim. As a result of accident, the driver of the car viz., Moess Amalraj died on the spot and his daughters viz., Christina Jennifer and Crystal Joyece sustained injuries. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court and he is in judicial custody from 10.10.2025. Hence, he seeks 2/6

bail to the petitioner.

4. The learned Government Advocate (Criminal Side) submitted that there is no previous case pending against the petitioner. He further submitted that due to non appearance of the petitioner NBW was issued against him and that he was arrested and remanded in judicial custody. Hence, he opposed for grant of bail to the petitioner.

5. Taking into consideration of the facts and circumstances of the case and that there is no bad antecedents against the petitioner and also considering the period of incarceration suffered by him, this Court is inclined to grant bail to the petitioner, subject to the following conditions:

Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Principal District Court, Karur, and on further conditions that :- [a] the sureties shall affix their photographs and Left 3/6

Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity.

[b] the petitioner shall appear before the concerned Court on all hearing dates without fail; [c] the petitioner shall not abscond either during investigation or trial.

[d] the petitioner shall not tamper with evidence or witness either during investigation or trial. [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
