ORDER

The petitioner has filed this contempt petition complaining that the order of this Court passed in Crl.O.P.(MD)No.11529 of 2024, dated 25.07.2024, has not been complied with by the respondent Police.

2. The petitioner has filed the above criminal original petition, seeking a direction to the respondent Police to complete the investigation in Crime No.302 of 2023.

3. The petitioner, as a complainant, has lodged the above complaint before the respondent Police in the year 2023 and the same was registered for the offences under Sections 120B, 420, 427, 448, 506(i) and 380 IPC and Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act. In the above criminal original petition, a stand has been taken by the respondent Police as if the petitioner has not co-operated for investigation by furnishing the required documents. However, it has been disputed by the learned counsel for the petitioner that the petitioner has furnished all the documents, even at the time of lodging the complaint. Considering the rival submissions made, this 2/6

Court, by order dated 25.07.2024, directed the petitioner to co-operate for investigation by furnishing all the documents, if any, available with her. This Court also directed the respondent Police to complete the investigation within a period of three months from thereon. Now, the petitioner has filed this contempt petition that the order of this Court passed in Crl.O.P.(MD)No.11529 of 2024, dated 25.07.2024, has not been complied with.

4. The learned counsel appearing for the petitioner submitted that subsequent to the order of this Court, the petitioner has furnished a copy of the documents to the respondent Police twice.

5. The learned Government Advocate (Crl. Side) appearing for the respondent Police submitted that the investigation has been completed and the final report has also been filed along with the documents, before the learned Judicial Magistrate No.IV, Madurai, in the month of February 2025. However, according to the respondent Police, the documents, which were filed along with the final report, are found missing and therefore, the final report has not been taken on file. 3/6

6. Considering the said submissions, this Court, by order dated 06.11.2025, directed the Registry to call for a report from the learned Judicial Magistrate No.IV, Madurai and list this case today.

7. Today, it is reported by the learned Government Advocate (Crl. Side) that the documents have been re-presented before the learned Judicial Magistrate No.IV, Madurai and the same has been taken on file in C.C.No.2955 of 2025.

8. Pursuant to the direction of this Court, the learned Judicial Magistrate No.IV, Madurai, has also filed a report that the final report along with the documents was taken on file in C.C.No.2955 of 2025 and the case is now posted on 08.01.2026 for issuance of summons to A1 to A4.

9. Since the final report in Crime No.302 of 2023 has been taken on file in C.C.No.2955 of 2025, this Contempt Petition is closed with a direction to the Superintendent of Police, Madurai, to ensure that the e-filing procedure has been properly conveyed to the Police Officers, 4/6

who are filing the final reports and these types of mistakes are not repeated in filing the final reports in future and also to ensure that the procedures as discussed in Macharaja vs. State of Tamil Nadu and others (Crl.O.P.(MD)No.12922 of 2025, dated 11.11.2025) are scrupulously followed to avoid any delay in processing the final reports. 18.11.2025 ogy NCC : Yes / No.
