Prayer:Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Certiorarified Mandamus calling for the records in connection with the application of the petitioner pending before the 1st respondent vide Application No.CB1075743381625 and quash the same as illegal and consequently direct the 1st respondent to process the application of the petitioner and to reissue passport to the petitioner within the time as fixed by this Court.

O R D E R

The present writ petition has been filed seeking to quash the show cause notice issued by the first respondent why passport of the petitioner cannot be impounded.

2.It could be seen from the records that the petitioner was implicated in a criminal case in Crime No.13 of 2018 on the file of CSCID-Dindigul Police Station, CSCID -Madurai District.

3. According to the learned counsel for the writ petitioner, though the petitioner was convicted only the fine was imposed and the fine amount has already been paid. She further submitted that the petitioner was implicated in another criminal case in Crime No.292 of 2023 on the file of Palani Adivaram Police Station, Dindigul District in which investigation is pending and so far, a charge sheet has not been filed.

4.Considering the above said facts that only a show cause notice has been issued, it is for the petitioner to appear before the first respondent and explain the circumstances. Therefore, the writ petition is not maintainable. 5.The petitioner can very well approach the first respondent and explain the circumstances under which the criminal case came to be filed. On submission of the explanation, the authorities are directed to dispose of the request of the petitioner within a period of four weeks thereafter. 2/4

6.With the above said observations, the writ petition stands disposed of. No costs.
