ORDER

Heard both sides.

2.The petitioner challenges the impugned award passed by the Chit Registrar. The stand of the writ petitioner is that he never signed in the guarantee document relied on by the second respondent for granting loan in favour of one Shanmugapriya. The petitioner feigns ignorance about the said Shanmugmpriya.

3.These are disputed facts. In writ proceedings, it may not be possible to adjudicate such issues. That apart, the petitioner has an effective appeal remedy before the Government. Even though the statute 2/6

prescribes the time limit, considering the special facts and circumstances of this case, if the petitioner files an appeal within three weeks from the date of receipt of a copy of this order, it shall be entertained by the appellate authority / Government without reference to limitation. The petitioner is at liberty to seek interim relief. If any such application is filed, it shall be disposed of on merits and in accordance with law within a period of eight weeks thereafter. The petitioner can canvass all the contentions now urged before this Court. It would be the duty of the appellate authority to consider those contentions both at the interim stage as well as final hearing stage. The award impugned in the writ petition shall not be enforced for a period of three months. 4.The Writ Petition is disposed of accordingly. No costs.
