ORDER : The Court made the following order :- The matter is posted today under the caption "for clarification". This Court, by order dated 24.11.2025 in Crl.O.P(MD).No. 18988of 2025, directed the petitioners to deposit a sum of Rs. 3,50,000/- (Rupees Three Lakhs and Fifty Thousand Only) to the credit of Crime No. 643 of 2025 before the Judicial Magistrate Court No. I, Padmanabhapuram.

2. Now, the defacto complainant has prayed to withdraw the said amount. It is noted that there is a money dispute between the accused and the defacto complainant. The accused contends that he has received a sum of Rs. 7,20,000/-, whereas the defacto complainant contends that he has received a sum of Rs. 8,20,000/-."

3. In view of the above, the defacto complainant is permitted to withdraw a sum of Rs. 2,50,000/- (Rupees Two Lakhs and Fifty 2/4

Thousand only) from the amount deposited in connection with the above crime. After the withdrawal, the balance amount of Rs. 1,00,000/- shall be deposited by the learned Judicial Magistrate Court No. I, Padmanabhapuram, in an interest-bearing Fixed Deposit in any nationalized bank, initially for a period of one year, and renewed periodically until the final order/judgment is passed. The learned Judicial Magistrate or Trial Court shall determine the entitlement to the said amount in its final order/judgment.

4. The order is clarified accordingly.
