Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a WRIT OF Certiorarified Mandamus to call for the records relating to the impugned order of suspension passed by the 3rd respondent in R.O.C.No.713/B/2024, dated 29.07.2024 and quash the same and consequently direct the respondents to reinstate the petitioner into service and pass orders in accordance with law. 1/4

ORDER

This writ petition is filed challenging the order of suspension passed by the 3rd respondent in R.O.C.No.713/B/2024, dated 29.07.2024 and seeking consequential direction to the respondents to reinstate the petitioner into service.

2. Even though the order of suspension had been made on the ground that the petitioner had been detained under custody for more than 38 hours for the offence committed by him under section 138 of Negotiable instrument Act, against which, the petitioner had filed an appeal and he has also been enlarged on bail. The order of suspension was made on 29.07.2024 and therefore such order of suspension is liable to be reviewed as per Government Order in G.O.Ms.No.81, Human Resources Management Department, dated 04.08.2022.

In such view of the matter, the writ petition stands disposed of with a direction to the 3rd respondent to review the order of suspension dated 29.07.2024 with reference to the Government Order in G.O.Ms.No. 81, Human Resources Management Department, dated 04.08.2022. The said exercise shall be carried out within a period of eight weeks from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petitions are closed.
