Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a WRIT OF Mandamus directing the respondent to pay the petitioner interest at the rate of 18% per annum, for the period of delay from 01.02.2024 to 24.08.2025, in paying the amounts paid towards his terminal benefits namely EPF Employee's contribution, Gratuity and Encashment of leaves / Already Surrendered Earned Leaves within a time frame as may be fixed by this court and without affecting his right to claim balance amounts towards those benefits.

ORDER

This writ petition has been filed for a writ of Mandamus to directing the respondent to pay the petitioner interest at the rate of 18% per annum, for the period of delay from 01.02.2024 to 24.08.2025, in paying the amounts paid towards his terminal benefits namely EPF Employee's contribution, Gratuity and Encashment of leaves / Already Surrendered Earned Leaves within a time frame as may be fixed by this court and without affecting his right to claim balance amounts towards those benefits.

2. Considering the admitted fact that there has been a delay in payment, the petitioner is entitled to statutory interest as provided under law.

3. In view of the same, the writ petition stands disposed of. The respondent is directed to pay interest at the rate of 6% per annum on the belated terminal benefits payable to the petitioner from the date of his entitlement till the date of his payment within a period of 12 weeks from the date of receipt of a copy of this order. No costs.
