Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct to the respondents to change the petitioner date of birth as 30.12.1989 instead of 23.06.1986 in the petitioner's school records i.e.. 10th and 12th Standard Mark Sheets and Transfer Certificate by consider the petitioner's representation dated on 14.05.2025 within the period that may be stipulated by this Court. ORDER
This writ petition has been filed seeking issuance of a Writ of Mandamus to direct the respondents to change the petitioner's date of birth as 30.12.1989 instead of 23.06.1986 in the petitioner's school records, namely, the 10th and 12th Standard Mark Sheets and Transfer Certificate, by considering the petitioner's representation dated 14.05.2025, within a time frame that may be stipulated by this Court.
2. Mr.T.Amjadkhan, learned Government Advocate, takes notice for the respondents 1 to 4. Since no adverse order is going to be passed as against the 5th respondent, notice to them is dispensed with. By consent, the writ petition itself is taken up for final disposal at the admission stage. 2/5
3. The learned counsel for the petitioner submitted that though the petitioner's actual date of birth is 30.12.1989, due to inadvertent mistake, it was entered as 23.06.1986 in the school records. It is further submitted that the petitioner has produced necessary documents in support of the correct date of birth and has made a detailed representation on 14.05.2025 to the authorities concerned seeking correction, but till date, no orders have been passed. Hence, the present writ petition has been filed.
4. The learned Government Advocate appearing for the respondents 1 to 4 submitted that the petitioner's representation will be considered in accordance with law and appropriate orders will be passed after verifying the records and affording an opportunity to the petitioner.
5. Considering the limited nature of relief sought and taking into account the submissions made on either side, this Court, without expressing any opinion on the merits of the petitioner's claim, directs the third respondent to consider the petitioner's representation dated 14.05.2025, and pass appropriate orders on merits and in accordance with law, after affording an opportunity of hearing to the petitioner, within a period of two months weeks from the date of receipt of a copy of this order. 3/5
6. With the above direction, this Writ Petition stands disposed of. No costs.
