ORDER

This writ petition has been filed for a mandamus to direct the 1st respondent to consult and include the members of the town vending committee six members in the selection process before finalizing the alternative site for accommodating the existing Street Vendors in the light of provisions contained scheme and Rule 13 (1) (a) (b) (c) (d) of Tamil Nadu Street Vendors (Protection of livelihood and Regulation of Rules 2015 by considering petitioner Street vending) Scheme and representation dated 15.10.2025.

2. Mr.D.Sasikumar, learned Additional Government Pleader takes notice on behalf of the 1st respondent and Mr.K.R.Kishore Ram, learned counsel takes notice on behalf of the 2nd respondent. 2/6

3. By consent of both the parties, the writ petition is disposed of at the time of admission stage itself.

The facts as set out in the affidavit filed in support of the writ petition reads as follows:- The 1st petitioner would submit that there are more than 1000 street vendors engaged in the street vending business at four places in the Trichy Corporation viz., Theppakulam, Nandhi Kovil Street, Port Arch and NSB Road. He would submit that among 1000 street vendors, 15 members have been elected as a Town Vending Committee, out of which he and the petitioners 2 to 6 have been elected as a members of the Town Vending Committee. He would submit that on 29.09.2025, the members of the Town Vending Committee had conducted a meeting and made a resolution that they will not evict the vendors from the present/original place until all the street vendors were allotted an alternative place. The said resolution was also communicated to the respondents. At this juncture, the 2nd respondent is searching an alternative place to shift all the street vendors within the jurisdiction of Trichy Corporation. 3/6

He would further submit that as per Section 18(1) of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014, the local authority can relocate the street vendors, however only on the recommendations of the Town Vending Committee. Therefore, the authorities must consult and receive recommendations from the Town Vending Committee before relocating the street vendors from the present/original place to an alternative place.

He would further submit that on 15.10.2025, he sent a representation to the respondents to include the members of the Town Vending Commitee in the selection process of alternative place for the street vendors. However, no action has been taken to date. Therefore, the petitioner has come before this Court.

7. Mr.D.Sasikumar, learned Additional Government Pleader appearing for the 1st respondent would submit that representation submitted by the petitioner dated 15.10.2025 will be considered and final orders will be passed within the time stipulated by this Court. 4/6

In view of the same, without expressing any opinion on the merits of the matter, the 1st respondent is directed to consider the representation of the petitioner dated 15.10.2025 and pass final orders on merits and in accordance with law, within a period of six (6) months from the date of receipt of a copy of this order.

9. With the above observations, the writ petition stands disposed of. No costs. Consequently, connected miscellaneous petitions are closed. 03.11.2025 NCC :yes/No Index :yes/No Internet:yes/No rgm 5/6
