O R D E R

(Order of the Court was made by C.V.Karthikeyan, J.) The Habeas Corpus Petition has been filed by a mother stating that her daughter had been missing on and from 08.10.2015. The daughter was born on 04.04.2007. In this connection, a complaint had been lodged with the second respondent and FIR in Crime No.295 of 2025 had been registered on 08.10.2025 under the caption "woman missing".

2. Today the second respondent had secured the daughter of the petitioner and brought her before this Court. It is stated that she had moved away with another individual, who had also been secured and kept in a home. The petitioner and her husband are present. We had sought affidavits from both of them that they would not commit any harm either to the daughter or to the particular boy. They both filed affidavits which are similar in nature and we would extract paragraph Nos.5, 6 and 8, which are as follows:

"5. I further submit that the said boy belongs to a different community and is minor (aged 17 years). After due counseling and in presence of police officials and family elders mutually agreed that the girl will return to her parental home and continue her education and assured that there will be no further communication between them until he attains Majority.

6. I hereby undertake before this Hon'ble court that neither I nor any of my family members will indulge in any act of cruelty harassment or intimidation against my daughter Monisha and the said boy or his family members. In will provide her full care, affection, and protection in our home.

8. I further submit that the matter has now been amicably settled and no grievance or criminal element survives in this case. Hence I respectfully pray that this Hon'ble court may be to record the same and close the Habeas corpus petition."

3. We have also called the petitioner and her husband and counselled them that it would be in their own interest to let the matters to rest. The daughter had agreed to go with the petitioner. The petitioner

had also accepted to take her daughter back into their family and also to continue her education. We are informed that she is studying Lab Assistant course.
