Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the second respondent herein to issue the patta to the petitioner with regard to property in survey No.196/5 to an extent of 0.60.5 Ares situated at Thepperumanallur Village, Thiruvudaimaruthur Taluk, Thanjavur District in the light of the judgment and decree dated 31.07.2006 made in O.S.No.336 of 2004 on the file of the Additional District Munsif, Valangaiaman at Kumbakonam based on his representation dated 22.09.2025.

O R D E R

The petitioner asserts that the property in survey No.196/5 of an extent of 60.5 ares was inherited by his father, Govindaraj Padayachi by way of an oral partition. Thereafter, it is stated that the petitioner's father had borrowed from one Kaliamurthy by mortgaging the above property. A suit was filed by the lender against the petitioner and his family members. The counterclaim for recovery of possession was decreed and the petitioner took possession pursuant to the orders in E.P.No.5 of 2019. Thereafter, the present Writ Petition has been filed after filing an online application on 19.08.2025 for grant of patta.

2. Learned Special Government Pleader accepts notice for both the respondents. He submits that an inquiry would be conducted after issuing notice to all interested parties and a speaking order would be issued within three (3) months from the date of receipt of a copy of this order.

3. In these facts and circumstances, without expressing any opinion on the merits, this Writ Petition is disposed of by directing the 2/4

second respondent to conduct an inquiry in relation to the petitioner's application for patta and issue a speaking order thereon within three (3) months from the date of receipt of a copy of this order after providing a reasonable opportunity to the petitioner and all parties interested in the relevant property. No costs.
