ORDER

This writ petition has been filed seeking issuance of a Writ of Certiorarified Mandamus to call for the records pertaining to the impugned order passed by the second respondent in proceedings No. Na.Ka.No. 3090/2025/A1 dated 04.06.2025, quash the same as illegal and arbitrary, and consequently direct the second respondent to issue a Class-II Legal Heir Certificate in respect of the petitioner's father's brother, Palani, in favour of the petitioner.

2. Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents. Perused the materials placed on record.

3. In order to establish that the petitioner is the Class-II legal heir of his father's brother, Palani, the petitioner is required to produce the Legal Heir Certificate of his grandfather, Palani, and also the Legal Heir Certificates of the children of the said Palani, namely, Periyasamy, Velu, Chinnakaruppan, Palani, and Karuppayi. Only upon production of such documents, the authorities would be in a position to verify whether the petitioner is the sole Class-II legal heir of his father's brother, Palani. 2/4

4. The learned counsel for the petitioner submits that it is not possible for the petitioner to obtain the Legal Heir Certificates of all the aforesaid persons. If that be so, the proper remedy available to the petitioner is to file a civil suit seeking declaration to establish his status as a legal heir.
