Prayer: Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Certiorari, to call for the records pertaining to the impugned order of the third respondent in Na.Ka.No.1109/2025/A9, dated 24.10.2025 and quash the same.

ORDER

Heard both sides.

2. The petitioner challenges the impugned order passed under Section 6 of the Land Encroachment Act. The petitioner fairly admits that he does not have any right over the land in question. No patta has been issued in his favour. The petitioner has encroached upon a water body. They only seek reasonable time to vacate. The petitioner also undertakes to file an affidavit agreeing to vacate at the end of the said period.

3. In view of the aforesaid undertaking given by the petitioner, we direct the third respondent to keep the impugned order in abeyance exactly for a 2/4

period of eight months. This concession will not be available to the writ petitioner if the undertaking is not filed before the third respondent within a period of two weeks.
