Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 to 3 to remove the encroachment of water body in Kardipatti Kulam, Kosavan Kuttai and Kuttai Kulam and its channels in Survey Nos.564, 595, 594, 593, 585, 584, 475/4, 442/1, 430, 431/19 (Detail Odai) 432/12, 435/10, 436/4, 351, 351/1, 352/1, 582/7, 583/8, 577/1, 580, 616 by considering the petitioner's representation dated 03.06.2025.

ORDER

Heard both sides.

2.It is not in dispute that the petition mentioned survey numbers have been classified as waterbodies either there are tanks or channel runs through them. The petitioner alleges that there are encroachments and that they should be removed.

3.The learned Special Government Pleader, on instructions, states that detailed survey has already been conducted in respect of all but four survey numbers. The remaining survey exercise will be completed within a period of four weeks. Before conducting survey, notices will be issued to all the interested parties including encroachers. Once the encroachments are identified, the statutory procedures will be adopted and after giving fair opportunity to all the encroachers, the encroachments will be removed within a period of three months thereafter.
