ORDER
The petitioners seek to quash the final report in C.C.No.512 of 2025 on the file of the learned Judicial Magistrate No.II, Madurai, which was filed for the offences under Sections 468, 471, 406, 420 IPC. 2.The gist of the allegation is that the petitioners on the promise of obtaining a job had received a total sum of Rs. 11 lakhs and neither obtained a job nor returned the money.

The learned counsel for the petitioners would submit that the parties have entered into a compromise and the defacto complainant agreed not to pursue the impugned proceedings on receipt of Rs.10 Lakhs; that he had already received Rs 3 Lakhs and that he has agreed to Rs.6 lakhs in cash today and a further sum of Rs.1 Lakh by withdrawing the amount deposited by the 3rd accused to the credit of Crime No.506 of 2022 before the learned Judicial Magistrate No.II, Madurai.
4. The petitioners and the second respondent / defacto complainant are present before this Court in person. They are identified 2/5
by Ms.A.Jeyalakshmi, WSSI, DI, Tallakulam Police Station, Madurai District. The defacto complainant would confirm the said compromise and receipt of Rs.3 Lakhs and further sum of Rs.6 lakhs in cash and also submitted that he may be permitted to withdraw the sum of Rs.1 lakh deposited by the 3rd accused. All the parties confirmed the compromise arrived at between them. The parties have filed a joint compromise memo dated 6th November 2025.

Considering the fact that the dispute is private in nature and the parties have arrived at a compromise this Court is inclined to quash the impugned proceedings in C.C.No.512 of 2025, as no useful purpose would be served in keeping the impugned final report pending investigation. The defacto complainant is permitted to withdraw Rs.1 Lakh deposited by the 3rd accused to the credit in Crime No.506 of 2022. The 3rd accused shall handover the deposit receipt to the defacto complainant. The petitioners 1 and 2 / accused 1 and 2 are permitted to withdraw Rs.2 Lakhs already deposited by them to the credit of Crime No.506 of 2022 before the learned Judicial Magistrate No.II, Madurai. 3/5
6. With the above observation, this Criminal Original Petition stands allowed. The petitioners shall pay a cost of Rs.10,000/- (Rupees Ten Thousand only) to the credit of the "District Siddha Medical Officer, CCRI, Periyakulam" (Account No.10767823177, IFSC Code: SBIN0000898, MICR Code: 625002601) and file a photocopy of the receipt along with a memo reporting compliance in the Registry. The joint compromise memo dated 06.11.2025 shall form part and parcel of this order.
