Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to change the investigation to CBCID and to file final report in respect of the case registered in FIR in Crime No.367/2025 on the file of the fifth respondent.

ORDER

The petitioner seeks a direction to the respondents to transfer the investigation in Crime No.367 of 2025 from the file of the fifth respondent to the CBCID.

2.The main grievances of the petitioner are that though several accused have been named, only a few of them have been cited in the FIR and that the accused against whom the complaint was lodged have not been arrested by the police so far.

3.The Additional Public Prosecutor would submit that there was no delay in lodging the complaint; that the respondent police are conducting the investigation in an effective manner and that therefore, there is no reason to transfer the investigation at this stage. 4.In view of the rival submissions, this Court is of the view that it would suffice to direct fifth respondent to conduct the investigation and file a final report within a period of three months from the date of receipt of a copy of this order under the supervision of the Deputy Superintendent of Police, Illupur Sub Division, Pudukkottai District. 5.With the above direction, this Writ Petition is disposed of. No costs.
