..Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus to call for the records of the 3rd respondent in order bearing Nil dated 24.10.2025 in respect of Notice Inviting Tender No.R-01CE/RCM and BMR/2025-26/D. 1/4

886 Dated 02.04.2025 issued by 2nd respondent and quash the same and consequently direct the 2nd respondent to consider the petitioner's financial bid.

ORDER

This Writ Petition has been filed seeking issuance of a Writ of Certiorarified Mandamus to call for the records of the third respondent in the order bearing Nil dated 24.10.2025 in respect of the Notice Inviting Tender No.R-01CE/RCM and BMR/2025-26/D.886 dated 02.04.2025 issued by the second respondent, quash the same, and consequently direct the second respondent to consider the petitioner's financial bid.

2. When the matter was taken up for hearing, the learned Standing Counsel appearing for the respondents 2 and 3 produced written instructions, wherein it has been stated as follows: "Now on 28.10.2025, the petitioner submitted documents claiming to qualify in the tender based on the Minimum Qualification Criteria. Now, the matter would be 2/4

placed before the Tender Committee again for recommendation. Based on the recommendation of the Tender Committee, the Price Bid would be opened."

3. In view of the above communication, it is clear that the respondents 2 and 3 would take a fresh decision on the petitioner's qualification and proceed further in accordance with the recommendation of the Tender Committee.
