Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 1st Respondent to consider and pass order on the petitioner's exparte final order set aside petition dated 17.01.2012 for setting aside the exparte final order dated 20.12.2011 in proceedings No. 4956/2005/A3 passed by the 1st Respondent and consequently direct the 1st Respondent not to evict the petitioner from the Shop No. 44 Arulmighu Mariamman Kovil, Irukkankudi till such time.

(Order of the Court was made by K.K.SASIDHARAN, J) The petitioner filed this writ petition to consider the application by the first respondent and set aside the exparte final order dated 20 December 2011.

2.The learned counsel for the second respondent, on instructions, submitted that nothing survives for adjudication in this matter, in view of the subsequent events relating to the dispossession of the petitioner and auctioning the property by the temple.

3.In view of the subsequent events, this writ petition is closed. No costs. Consequently, connected miscellaneous petition is also dismissed.
